1. Acceptance of Terms

By accessing or using Afriqahome, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

2. Description of Service

Afriqahome is a real estate marketplace connecting property seekers with verified agents across Kenya. We provide a platform for agents to list properties and for buyers and renters to discover and inquire about properties. Afriqahome does not own, sell, rent, or manage any properties listed on the platform. We act solely as an intermediary connecting users with real estate professionals.

3. User Accounts

To access certain features of Afriqahome, you must create an account. You are responsible for:

Providing accurate and complete registration information
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

Agents must complete our verification process before listing properties. We reserve the right to suspend or terminate accounts that violate these terms or our policies.

4. Property Listings

Agents are solely responsible for the accuracy, completeness, and legality of their property listings, including:

Property descriptions and specifications
Pricing and availability information
Images and media content
Location and address details

Afriqahome reserves the right to remove, modify, or refuse any listing that violates our policies, contains inaccurate information, or is otherwise deemed inappropriate.

5. Prohibited Conduct

Users of Afriqahome are prohibited from:

Posting fraudulent, misleading, or fake property listings
Impersonating others or misrepresenting affiliations
Harassing, threatening, or abusing other users
Scraping, crawling, or automated data collection without permission
Circumventing security features or access controls
Using the platform for any unlawful purpose
Interfering with the proper functioning of the platform

6. Payments & Subscriptions

Afriqahome offers subscription plans for agents, including Elevate and Dominate tiers, as well as Spotlight boost features. Payment terms:

Payments are processed via M-Pesa (Safaricom)
Subscription fees are billed according to the selected plan period
Refunds are available within 7 days of purchase for subscriptions
After 7 days, subscriptions and Spotlight purchases are non-refundable
We reserve the right to modify pricing with reasonable notice

7. Intellectual Property

Afriqahome and its original content, features, and functionality are owned by Afriqahome and are protected by international copyright, trademark, and other intellectual property laws. Users retain ownership of content they submit but grant Afriqahome a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content on the platform for the purpose of providing our services.

8. Limitation of Liability

Afriqahome is a marketplace platform and is not a party to any transactions between buyers, renters, and agents. We are not liable for:

The accuracy of property listings or agent representations
Disputes between users regarding property transactions
Any damages arising from the use of our platform
Third-party actions or content

Users agree to conduct their own due diligence before entering into any property transaction.

9. Privacy

Your use of Afriqahome is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review our Privacy Policy for more information.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the platform. Your continued use of Afriqahome after any changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from these terms or your use of Afriqahome shall be resolved in the courts located in Nairobi, Kenya.
